These Terms of Service (“Terms”) govern your access to and use of the website, platforms, and services provided by AlexMining (“we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance and Eligibility

By creating an account or using our mining, hosting, or related services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the authority to bind yourself or your organization, and are not prohibited by applicable law from using our services. You are responsible for ensuring that your use of our services complies with all applicable laws in your jurisdiction.

2. Description of Services

AlexMining provides blockchain mining infrastructure and related services, which may include:

• Mining hosting and hashrate allocation
• Proprietary hashrate operations and mining pool connectivity
• Institutional and customized mining solutions
• Compliance, reporting, and support services

Specific services, features, and service levels are described in your agreement, order form, or dashboard. We may modify, suspend, or discontinue any service with reasonable notice where practicable, except where prohibited by contract or law.

3. Account and User Obligations

You must provide accurate and complete information when registering and keep your account details and payment methods up to date. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. You must notify us promptly of any unauthorized access. You agree not to use our services for any illegal purpose, to violate any applicable law, or to infringe the rights of others. You must not attempt to gain unauthorized access to our systems or those of our users or partners.

4. Fees and Payment

Fees for our services are as set out in your agreement, order form, or our then-current pricing. You agree to pay all applicable fees on time. Failure to pay may result in suspension or termination of services. Fees are generally non-refundable unless otherwise agreed or required by law. We may change fees with notice as permitted by your agreement.

5. Mining Output and Wallets

Mining output (e.g., mined digital assets) will be delivered in accordance with your service agreement. You are responsible for providing valid wallet addresses and for the security of your wallets. We are not responsible for loss of assets due to incorrect, compromised, or incompatible wallet addresses. Tax reporting and compliance with tax laws are your responsibility.

6. Intellectual Property

We retain all rights in our brand, technology, software, and content. You receive no license to our intellectual property except as necessary to use our services in accordance with these Terms. You may not copy, modify, reverse engineer, or create derivative works from our systems or content without our prior written consent.

7. Disclaimer of Warranties

Our services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation or any specific level of hashrate, mining output, or return.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AlexMining and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with your use of our services. Our total liability for any claims arising from or related to these Terms or the services shall not exceed the fees you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless AlexMining and its affiliates, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of our services, your breach of these Terms, or your violation of any law or third-party rights.

10. Termination

We may suspend or terminate your access to our services at any time for breach of these Terms, non-payment, or for any reason with notice where required. You may terminate your account or service as permitted by your agreement. Upon termination, your right to use the services ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction specified in your agreement or, if none, the laws of the jurisdiction in which AlexMining operates. Any dispute arising out of or relating to these Terms or the services shall be resolved in the courts of that jurisdiction, except where prohibited by mandatory law.

12. Changes to the Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes may be communicated by email or through our platform. Continued use of our services after the effective date of changes constitutes acceptance of the revised Terms where permitted by law. If you do not agree, you must stop using our services.

13. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms, together with our Privacy Policy, Compliance & Risk Disclosure, and any applicable agreement or order form, constitute the entire agreement between you and AlexMining regarding the services.
